Terms and Conditions and Warranty 

Information for Consumers Regarding Distance Sales Contracts and Customer Information for E-Commerce Contracts

Section 1 Scope of Application

For business relationships between us and the customer, the following General Terms and Conditions, in the version valid at the time of the order, apply to orders placed through the online store.

§ 2 Conclusion of the Contract

The presentation of our products on our website constitutes merely an invitation to the customer to submit a contractual offer. By submitting an order, the customer makes an offer within the meaning of § 145 of the German Civil Code (BGB). The customer will receive confirmation of receipt of the order via email. The contract with us is concluded when we accept the customer’s offer in writing or in text form within 2 business days of the order being submitted. In this regard, the time at which the customer receives the declaration of acceptance is decisive. A business day is any calendar day that is not a Sunday or a nationwide statutory holiday.

§ 3 Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. In addition, we grant a voluntary right of return for a total of 100 days from receipt of the goods. Please refer to our separate withdrawal policy, which you can view under “Right of Withdrawal,” for the legal details and conditions. This will also be sent to you in text form (e.g., via email) after you complete your order.

§ 4 Delivery, Shipping Costs, Transfer of Risk

Delivery is subject to the shipping costs specified in each individual case. If the customer is a consumer, we bear the shipping risk in all cases, regardless of the shipping method. If the customer is a business, all risks and dangers associated with shipping are transferred to the customer as soon as the goods have been handed over by us to the contracted logistics partner.

§ 5 Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

§ 6 Payments

Only the payment methods displayed to the customer during the ordering process will be accepted.

§ 7 Liability for Defects

The statutory rights regarding liability for defects apply.

§ 8 Information for Consumers in Distance Sales Contracts and Customer Information for E-Commerce Contracts

a) We are not subject to any specific codes of conduct not mentioned above.
b) You can identify any input errors when placing your order during the final confirmation before submitting your contractual declaration and correct them at any time using the delete and edit functions before submitting the order.
c) Please refer to the individual product descriptions on our website for the essential characteristics of the goods we offer as well as the validity period of limited-time offers.
d) The language available for concluding the contract is English.
e) You may submit complaints and claims for liability for defects to the address provided in the provider identification.
f) We will store the text of the contract after its conclusion, and it will be available to the customer in the order confirmation via email.
g) Please refer to the offer for information regarding payment, delivery, or fulfillment.

§ 9 Information on Dispute Resolution Proceedings Before a Consumer Arbitration Board

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Refunds

We will automatically process any refunds to the account you used for payment. If you paid by invoice or in advance, the refund will be transferred back to the account from which the original transfer was made. If you paid via PayPal or credit card, we will refund the amount to the associated account. If you used a gift card, we will credit the corresponding amount to your gift card account; please contact our customer service for this.

Returns under the statutory right of withdrawal are governed by the provisions of our separate withdrawal policy. Please use our online returns portal for returns to ensure proper tracking and prompt processing of your shipment.

§ 11 Miscellaneous

The contractual relationship between us and the customer, as well as the respective terms and conditions, are governed by the laws of the Federal Republic of Germany. If the customer is a consumer, the statutory provisions and rights applicable under the law of the country in which the consumer has their habitual residence—which are intended to protect the consumer and from which no deviation is permitted by agreement—remain unaffected by this agreement. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

Additional Terms and Conditions for Invoice & Installment Purchases

Warranty Statement 

§ 1 Warranty Levels & Overview

In addition to the statutory rights regarding liability for defects (2-year warranty), we offer the following extended warranty options:

1. Free Newsletter Extended Warranty (+1 Year): A voluntary, free warranty extension for an additional 1 year following the statutory 2-year warranty. Activation and maintenance of this extended warranty require an active newsletter subscription of at least 6 months.
2. Paid Extended Warranty: A warranty extension that can be purchased separately during the ordering process. The specific terms and durations depend on the warranty option selected at the time of purchase.
   

§ 3 Warranty Claim & Processing

To file a warranty claim, please contact our customer support at info@gusti-leather.co.uk. To process the claim, we require proof of purchase and, in the case of the newsletter extended warranty, proof of active newsletter registration.

§ 4 Exclusions and Limitations

These warranties cover defects in materials and workmanship only. Damage resulting from improper handling, unauthorized modification of the product, normal wear and tear, or ordinary use is excluded. We do not cover the cost of repairing zippers.

§ 5 Return Conditions for Warranty Claims

We will cover the shipping costs for returns made under valid warranty claims, provided that only the return label provided by us is used. Refunds for self-paid returns are excluded.
